By using mysticaleden.com you agree to these terms. Read them before placing an order.

1. WHO WE ARE

Mystical Eden is operated by David Vaclavek, registered as self-employed in Malta.

2. ELIGIBILITY

You must be at least 18 years old to place an order, or have the consent of a parent or legal guardian.

3. ORDERS

When you place an order, you are making an offer to buy. Your order is accepted only when we send a confirmation of dispatch. We may decline or cancel any order, including for stock issues, pricing errors, or suspected fraud, and will refund you in full if we do.

4. PRICING AND PAYMENT

All prices are in EUR and include applicable taxes where shown. We may change prices at any time. The price you pay is the price displayed at checkout. Customs duties and import taxes outside the EU are the responsibility of the recipient.

5. SHIPPING AND DELIVERY

Shipping terms, timeframes, and tracking are set out in our Shipping Policy. Delivery dates are estimates, not guarantees.

6. RIGHT OF WITHDRAWAL

If you are a consumer in the EU, you have the right to cancel your order within 14 days of receiving it, without giving a reason, in line with the Consumer Rights Directive.

To exercise this right, email info@mysticaleden.com with your order number before the 14 days expire. You then have a further 14 days to return the item in unworn, original condition. Return shipping is at your cost.

The right of withdrawal does not apply to bespoke commissions, customised pieces, or items engraved or altered to your specification. These are final sale.

7. RETURNS AND REFUNDS

Full return and refund procedure is in our Refund Policy. Refunds are issued to the original payment method within 14 days of receiving the returned item.

8. STATUTORY WARRANTY

EU consumers have a statutory right to a two-year warranty on goods that do not conform to their description at delivery. This right is in addition to anything stated on this site and cannot be waived.

9. PRODUCT REPRESENTATION

We use natural and lab-grown stones. Each piece is unique. Colour, inclusions, and finish may vary slightly from the photographs. Screens display colour differently. Variation is part of the material, not a defect.

10. BESPOKE COMMISSIONS

Bespoke pieces are made to your specification. They are non-returnable and non-refundable except where the piece does not match the agreed brief or arrives damaged. Full bespoke terms are confirmed in writing before any work begins.

11. INTELLECTUAL PROPERTY

All content on this website, including images, copy, design, and the Mystical Eden name and marks, belongs to Mystical Eden. You may not reproduce, distribute, or use any of it for commercial purposes without written permission.

12. USER CONDUCT

You agree not to use this website to transmit unlawful content, attempt to breach security, or interfere with its operation. We may suspend access for any user we suspect of misuse.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mystical Eden is not liable for indirect or consequential loss arising from the use of this website or our products. Our total liability is limited to the value of your original purchase. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.

14. FORCE MAJEURE

We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, postal disruption, war, or government action.

15. PRIVACY

How we handle your personal data is set out in our Privacy Policy.

16. CHANGES TO THESE TERMS

We may update these terms. The version published on this page at the time of your order is the version that applies to that order.

17. GOVERNING LAW AND JURISDICTION

These terms are governed by the laws of Malta. Disputes are subject to the non-exclusive jurisdiction of the courts of Malta. EU consumers retain the protection of mandatory rules in their country of residence.

18. ONLINE DISPUTE RESOLUTION

EU consumers may use the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to submit a complaint. We prefer to resolve issues directly. Email info@mysticaleden.com first.

19. SEVERABILITY

If any clause in these terms is held to be invalid or unenforceable, the rest of the terms remain in full effect.
